Always Check Your Builder searched and found out ...
3 of his building jobs last year ended up in the courts but yes 2 were perfect.
His truck's been repossessed and he's got 2 defaults against his equipment leases.
His company hasn't filed a tax return in 2 years and his partner is banned from holding a builders licence.
Between them they've had 3 building companies go into liquidation and a heap of sub-contractors won't work for them anymore.

Contract Caution

What is Implied Builders Warranty

The law requires a builder to meet certain obligations when they do building work.
These are called 'warranties' in the Domestic Building Contracts Act 1995, and 'consumer guarantees' in the Australian Consumer Law.
You have rights under both laws.
Consumer guarantees and implied warranties apply by law and cannot be signed away.
The (Australian) Domestic Building Contracts Act 1995 states that every builder who enters into a domestic building contract provides the following implied warranties to the owner:
All work will be carried out in a proper and workmanlike manner
All work will be carried out in accordance with the plans and specifications set out in the contract
All materials to be supplied by the builder will be good and suitable for their intended purpose, and that unless otherwise stated the materials will be new
All work will comply with all laws and legal requirements
The with will be carried out with reasonable care and skill
The home will be suitable for occupation at the time the work is completed
The builder should check out every allegation of defective building work on its merits and assess whether he or she is actually responsible
Damage caused by use or by other contractors is not the builder's responsibility, neither is any deviation within permissible tolerances
